    Welcome to NiceGen.ai, an AI-powered creative platform for image and video generation, editing, and enhancement (the "Service"). By accessing or using our website at https://nicegen.ai/ (the "Site"), you agree to be bound by these Terms of Service (the "Terms"). These Terms govern your use of the Site and the Service provided by NiceGen.ai ("we," "us," or "our").

    1. Eligibility

    2. Account Registration

    To access certain features, you may need to create an account. You agree to provide accurate, complete, and current information during registration and to keep it up to date. You are responsible for safeguarding your account credentials and for all activities that occur under your account, whether authorized or not. Notify us immediately at support@nicegen.ai if you suspect any unauthorized use.

    3. Use of the Service

    Permitted Use

    NiceGen.ai grants you a limited, non-exclusive, non-transferable, and revocable license to use the Service for lawful purposes, subject to these Terms. You agree not to use the Service for any purpose that is unlawful or prohibited by these Terms.

    Prohibited Conduct

    You agree not to:

    • Generate or distribute content that is illegal, harmful, abusive, defamatory, obscene, or otherwise objectionable.
    • Reverse engineer, decompile, or disassemble any part of the Service.
    • Use bots, scrapers, or other automated systems to access the Site or the Service without authorization.
    • Interfere with or disrupt the Service or the servers and networks supporting it.
    • Use the Service to infringe upon the intellectual property or privacy rights of others.
    • Bypass safety mechanisms, content filters, or rate limits of the Service.

    4. Credits and Payments

    Credits

    • Credits are non-transferable, have no monetary value outside the Service, and cannot be exchanged for cash.
    • Credits are sold as one-time add-on packs and are added to your account balance immediately after purchase.
    • Credits are consumed when you use paid generation features. The cost per generation is displayed before you confirm.

    Fees and Billing

    Certain features require payment. You agree to pay all applicable fees associated with your use of the Service. Payments are processed through third-party payment processors. By providing payment information, you authorize NiceGen.ai and its processors to charge the applicable fees to your payment method. NiceGen.ai may update its fees and billing methods upon notice to you.

    Credit Pack Purchases

    • Credit pack purchases are one-time charges, not recurring subscriptions.
    • All credit pack sales are final. Credits are non-refundable once added to your account, except where required by applicable law.
    • No partial refunds or prorated credits are issued for unused credits, except where required by applicable law.
    • Please review the credit amount and price before completing your purchase.

    5. User Content

    Ownership and Responsibility

    You retain ownership of any content — including prompts, images, videos, or other materials — that you upload or generate using the Service ("User Content"). You are solely responsible for the User Content you create, upload, publish, or share through the Service.

    License to NiceGen.ai

    By submitting User Content to the Service, you grant NiceGen.ai a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, and process such User Content solely as necessary to operate, secure, and improve the Service. We do not use your private content to train third-party foundation models without your explicit consent.

    Content Restrictions

    You agree not to upload, generate, or share User Content that:

    • Is misleading, false, or deceptive, particularly when presented as factual.
    • Violates any applicable law or regulation.
    • Depicts or promotes pornography, excessive violence, terrorism, extremism, or sensitive political campaigning.
    • Engages in unauthorized face-swapping or non-consensual intimate imagery.
    • Infringes intellectual property rights of others (including film, television, animation, game characters, and trademarks).
    • Contains unsolicited promotions, spam, or political solicitations.
    • Shares personal details of others without their explicit consent.
    • Discloses information you are not authorized to share due to legal, contractual, or fiduciary obligations.
    • Endangers or exploits children, including any sexual content involving minors (CSAM).
    • Contains malware, viruses, or other harmful code.
    • Contains explicit sexual material or themes.
    • Is otherwise deemed, in our sole judgment, inappropriate, disruptive, or harmful to other users or to NiceGen.ai.

    To maintain a safe environment, NiceGen.ai uses automated and manual systems to detect and restrict prohibited content. We reserve the right to remove violating content, suspend or terminate accounts, and report illegal activity to the appropriate authorities.

    Public Visibility

    The Service may allow you to make Generated Content publicly visible (for example, by publishing it to a public gallery). If you choose to make content public, you grant NiceGen.ai a non-exclusive, worldwide, royalty-free, sublicensable license to display, distribute, and promote that content within the Service and across our related marketing channels. Content kept private remains visible only to you.

    6. Intellectual Property

    Ownership of NiceGen.ai Content

    All intellectual property rights in the Site, the Service, and any content provided by NiceGen.ai — including software, text, graphics, logos, and trademarks — are owned by NiceGen.ai or its licensors. No rights or licenses are granted except as expressly stated in these Terms. To request additional usage rights, contact support@nicegen.ai.

    User Feedback

    Any feedback, suggestions, or ideas you provide regarding the Service ("Feedback") become the exclusive property of NiceGen.ai. You assign all rights in such Feedback to NiceGen.ai and agree we may use it without compensation to you.

    7. Third-Party AI Providers

    The Service relies on multiple third-party AI model providers to power its generation features. By using the Service and selecting specific models, you acknowledge that your inputs (such as prompts and uploaded media) may be processed by those providers solely to fulfill your generation requests, as described in our Privacy Policy.

    8. Termination

    Termination by You

    You may terminate your account at any time from your account settings. Upon termination, your right to access and use the Service ceases immediately.

    NiceGen.ai may suspend or terminate your account or access to the Service, with or without notice, for any reason, including violation of these Terms.

    Effect of Termination

    Upon termination, all licenses granted to you under these Terms end immediately, and you must cease all use of the Service. Provisions related to payment, intellectual property, disclaimers, limitation of liability, and indemnification survive termination.

    9. Disclaimer of Warranties

    The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory. NiceGen.ai does not warrant that the Service will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by law, NiceGen.ai disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

    10. Limitation of Liability

    To the maximum extent permitted by law, NiceGen.ai will not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or use — arising out of or in connection with your use of the Service, whether based on warranty, contract, tort, or any other legal theory, even if NiceGen.ai has been advised of the possibility of such damages.

    11. Indemnification

    You agree to indemnify, defend, and hold harmless NiceGen.ai and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising from your use of the Service, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.

    12. Miscellaneous

    Entire Agreement

    These Terms constitute the entire agreement between you and NiceGen.ai regarding your use of the Service and supersede any prior agreements.

    Severability

    If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent possible, and the remaining provisions will remain in full force and effect.

    Waiver

    Failure by NiceGen.ai to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

    Assignment

    You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. NiceGen.ai may freely assign these Terms without restriction.

    Changes to These Terms

    We may update these Terms from time to time. Changes are effective when posted on this page. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
